Section 1: The Issue of Corruption in International Arbitration

Corruption is a phenomenon occurring not only in the context of handling with public funds. It plays a negative role also for private-law relationships. National legislations regularly sanction corruption by both criminal and private law remedies. At the international level, several instruments fighting against corruption have been adopted (e.g. Convention on Combating Bribery of Foreign Public Officials in International Business Transactions (1997); Civil Law Convention on Corruption (1999), Criminal Law Convention on Corruption (1999); UN Convention against Corruption (2003). Thus, there is no doubt that the fight against corruption is in the public interest.

The issue of corruption is currently discussed also in the area of international arbitration. Therefore, we have decide to devote this year’s conference to this topic. We welcome papers dealing with various aspects of corruption within the context of both international commercial and investment arbitration. The papers can deal with the issue of arbitrability, validity of arbitration agreements, rights and duties of arbitrators (e.g. duty to find corruptive behaviour, notification duty), burden of proof, issue of applicable law including the application of criminal law provisions by arbitrators, impact on annulment or recognition and enforcement of arbitral awards. We will also accept papers dealing the international instruments against corruption, national criminal regulations against corruption as well as national private-law remedies against corruption.

Section 2: Contemporary Challenges to International Law and Policy on Sustainable Development, Energy, Climate Change, Environmental Protection, Intellectual Property and Technology Transfer

This section of COFOLA International 2018 is organised in cooperation with gLAWcal – Global Law Initiatives for Sustainable Development (United Kingdom), the European Society of International Law (ESIL) Interest Group on International Environmental Law and the American Society of International Law (ASIL) Interest Group on Intellectual Property Law.

Be aware that there are differences in the application process and from general schedule of COFOLA International 2018.
 
The following must be submitted to pdfarah@mail.wvu.edu and farah@glawcal.org.uk by March 25, 2018:
  • The author’s name and affiliation;
  • A 500-700-word abstract [Word file and PDF];
  • The author’s CV, including a list of relevant publications;
  • The author’s contact details, including email address and phone number;
  • Whether the author is an ESIL or ASIL member.
Multiple abstracts from the same authors will be considered, but only one can be selected. Co-authored multidisciplinary papers are also welcomed.
 
Applicants will be informed of the selection committee’s decision no later than March 30, 2018.
 
Selected applicants have to then submit the application to COFOLA International 2018 via the conference system of Faculty of Law, Masaryk University (see guidelines below). The application must be submitted no later than April 4, 2018.
 
After registration, a payment notice will be sent to your email. According to instruction in the notice, you will get an invoice in electronic form issued by Masaryk University Shopping Centre. It is not possible to pay the conference fee in cash on the day of the conference. In case your paper is not published (e.g. due to failure to comply with deadlines or prescribed format, etc.) or non-participation at the conference, the conference fee is not refundable. The conference fee can be paid by credit card. THE CONFERENCE FEE MUST BE PAID BY 15 APRIL 2018 AT LATEST OTHERWISE YOUR APPLICATION WILL BE CANCELLED.
 
Working papers are not required in this section.

Publication:
The best papers will be considered for publication in a Special Issue on Peer-reviewed or US Law Journal or in the Routledge Publishing (New-York/London) multidisciplinary gLAWcal book series on “Transnational Law and Governance”. In any case, there will be the possibility to publish the papers in the peer-reviewed post-conference proceedings with ISBN and ISSN in the printed form. We will submit these proceedings into databases Scopus and/or Web of Science.
